Compliance Through Education

There are a number of situations where an educational approach is more effective than enforcement action in achieving compliance.  These situations generally involve first-time violations committed by members of the general public or businesses that are not fully aware of District rules and regulations.  Under certain situations, minor violations may be issued a Notice to Comply (NTC) or a Record of Corrective Action Taken (RCAT).  These compliance actions allow the District to document non-compliance, educate the violator, and ensure swift corrective action without the need for further enforcement or penalties.

Notice To Comply

What Is A Notice To Comply?

A Notice to Comply is a written notice that a violation has been found and the owner/operator is being given until a specified date to take corrective action and return to compliance.  A Notice to Comply is like a "fix it ticket" that is issued for first-time, minor violations.  No additional action is taken so long as the violation is corrected by the due date.  However, if the violation is not corrected by the deadline, the District may issue a Notice of Violation.

What Should I Do If I Receive A Notice To Comply?

Take immediate action to correct all violations listed on the Notice to Comply.  Once compliance has been achieved, you must notify the District by contacting the issuing inspector or another member of the Compliance department.  Have the following information ready when you call:

  • Notice to Comply number
  • Violations cited
  • Corrective actions and the dates they were made

Corrective Action

In some cases, an Air District inspector may contact you to verify your corrective actions or request to see supporting records.  Once corrective action has been verified, the District will consider the matter closed.  However, if the violation is not corrected by the deadline, the District may issue a Notice of Violation.

Record of Corrective Action Taken

What Is A Record of Corrective Action Taken?

A Record of Corrective Action Taken (RCAT) is a written notice that a violation was found and was corrected in the presence of the inspector.  The Record of Corrective Action Taken is issued for first-time, minor violations similar to a Notice to Comply, with the key distinction that the violation has already been corrected, so no additional corrective action is required.
