Demolition or Renovation?

Demolition

The primary distinction of a demolition project is the removal of a load-bearing member of the structure, installation, or building together with any related handling operations. Additionally, the intentional burning of a building (such as fire-fighting agency training burns) or the separation of a structure from its foundation prior to relocation is considered a demolition.

Renovation

If no load-bearing members will be removed, the project would generally be classified as a Renovation for NESHAP purposes.

Demolition Project Requirements

The Asbestos NESHAP stipulates the following requirements:

  • Asbestos Inspection/Survey:   All of the potentially-asbestos-containing ("suspect") material in the structure to be demolished must be tested/surveyed for asbestos content.  Within District boundaries, this survey must be conducted by a Cal-OSHA Certified Asbestos Consultant, who will provide a report of the results.
  • Notification Submission. Must be submitted 10-working-days prior to the commencement of any regulated asbestos abatement:
    • Asbestos Notification: A completed and signed Asbestos Notification Form must be submitted.
    • Asbestos Survey: Provide a copy of the asbestos survey report
    • Notification Fees: Per Rule 3050, pay the required notification fees -- these may be paid online or via check with the notification materials. (See "Fee Rule" below)
    • Demolition Permit Release Form: The applicant completes the top portion of the form to include with the notification, and the District will return the signed Release form upon satisfaction of the NESHAP requirements.  The municipality who will issue a demolition permit needs to receive this form with the District's approval affixed.  
  • Asbestos Containing Material Abatement: Before the demolition may commence, all of the regulated asbestos abatement must be completed by a state-certified asbestos abatement contractor.
    • If there is no regulated asbestos (RACM) to be abated, only the demolition activity will be subject to the 10-working-day waiting period starting from the date of notification.

Residential Exclusion

The NESHAP for asbestos provides an exclusion from the testing and notification requirements for residential projects which meet specific qualifications.

Fee Rule - Demolition Projects
The fees required by District Rule 3050 are not determined by the structure's size or footprint.
Current Rule

Per Rule 3050, Notification Fees are determined by a tier structure of the Regulated Asbestos Content (RACM) quantities.

The total fee is calculated as the sum of the fees assessed for any regulated asbestos content of each of these categories:

*The minimum fee of one column in Tier 1 is required if no RACM is present. When RACM is present, fees are assessed for only the columns with RACM quantities greater than 0.

The notification documents can be sent by mail or email.  Please include proof of payment of the notification fees with the submission.  Select the corresponding office for the county where the project is located.
